You made a game, we host it and show it to players, and you get 40% of the net ad revenue it brings in. You keep your rights. This page sets out the details.

This text is a template: it must be reviewed by a qualified lawyer and every placeholder in [square brackets] completed before launch.
This agreement is between [COMPANY NAME], [REGISTERED ADDRESS], [COUNTRY] (“we”, “us”), operator of ChaosInOurMind, and you, the developer who submits a game (“you”). If you submit on behalf of a studio or company, you confirm that you are allowed to accept this agreement for it. It applies in addition to our terms of service. Where the two differ, this agreement applies to your game.
You submit a game through the developer page while logged in. The form asks for the game title, studio name, genre, a short pitch, a description, a contact email, and optionally a link to a build and/or an uploaded .zip file of up to 50 MB. Uploaded files are stored privately and are only accessed by our review team.
We review every submission by hand. Its status is pending, approved or rejected, and we may add a short review note. We decide freely which games we publish and do not have to explain a rejection in detail. Submitting does not create any obligation to publish. This agreement becomes binding for a game once we approve it and you confirm you want it published.
You keep all intellectual property rights in your game: code, art, music, story, characters and name. We do not buy your game and you are free to publish it anywhere else, including other websites, stores and platforms.
For as long as this agreement runs, you grant us a non-exclusive, worldwide, royalty-free licence to:
We will credit you as the developer on the game page. We will not change your game's content without your agreement, except for technical changes needed to make it run, such as file paths or the save SDK integration.
Your game must:
We may ask you to fix problems before or after publishing. [PLACEHOLDER: decide on an age-rating or content-warning policy for violence and mature themes.]
You receive 40% of the net ad revenue attributable to your game's pages and player. We keep the rest to cover hosting, development of the site and our work.
Net ad revenue means what our ad partners actually pay us for ads shown on your game's page and in its player, after deducting the ad network's fees and any VAT, and after refunds, chargebacks and deductions for invalid traffic. Revenue we earn from Supporter purchases is not included. Attribution is based on the reporting of our ad partners and our own page data. [PLACEHOLDER: describe how revenue is attributed when ad partner reports are not broken down per page.]
We do not guarantee any amount of traffic or revenue. Ad revenue depends on players, ad partners, consent choices and the market, and can be zero. Logged-in Supporters see no ads, so their plays do not generate ad revenue.
You must not generate artificial traffic, impressions or clicks, or ask others to do so. Revenue from invalid traffic is not paid out, and we may deduct it later if an ad partner reclaims it.
You are responsible for your own taxes and social security contributions on what you earn. Amounts in statements are stated [PLACEHOLDER: net of VAT / with VAT added where you are VAT registered]. If the law requires us to withhold tax or report payouts to authorities (for example under the EU DAC7 rules), we will do so and tell you.
You confirm that the information you give us is correct and that your game follows section 4. If someone makes a claim against us because your game infringes their rights or breaks the law, you will compensate us for reasonable costs and damages caused by that claim, unless the problem was caused by us. We will tell you about such a claim promptly and let you take part in the defence.
We host your game with reasonable care but do not guarantee uninterrupted availability or that files are never lost. Keep your own copies. Our liability for intent and gross negligence is unlimited. For slight negligence we are only liable for breaches of essential obligations and only for typical, foreseeable damage. Liability that cannot be limited by law stays unaffected.
The agreement runs for an unlimited time. Either of us can end it for a game at any time with 30 days' notice by email. We then remove the game from the site, and our licence ends. We may keep using screenshots or videos already published in past promotions (for example old social media posts) but will not create new ones.
We may remove a game immediately and suspend payouts for it, if:
We will tell you why, unless the law prevents it, and give you a chance to respond. Where the problem can be fixed, we will put the game back once it is fixed. Revenue legitimately earned before removal remains yours, except revenue from invalid traffic.
We use your submission and payout data only to run this agreement, pay you and meet our legal duties. Submissions are kept until 2 years after rejection or 2 years after the agreement ends; payout and tax records as long as accounting law requires. Details are in the privacy policy.
We may change this agreement, for example if ad partners change their terms. We will tell you by email at least 30 days in advance. If you do not agree, you can end the agreement before the change applies. A change of the revenue share to your disadvantage only applies to revenue earned after that notice period.
This agreement is governed by the law of [COUNTRY]. The courts of [PLACEHOLDER: city, country] have jurisdiction, unless mandatory law gives you the right to sue elsewhere. If you act as a consumer and not as a business, the mandatory consumer protection rules of your country of residence still apply. Let's talk first: most problems can be solved by email at hello@chaosinourmind.com.
